Generelle forretningsbetingelser

§ 1 Gyldighedsområde, kontraktindgåelse

  1. Disse generelle brugerbetingelser er indholdet af brugerforholdene mellem upjers GmbH, Hafenstraße 13, 96052 Bamberg (ejer) og brugerne af de elektroniske underholdningstilbud (brugere). Brugerens kontraktbetingelser indgår kun da i kontrakten, når ejeren udtrykkeligt accepterer det skriftligt. Med brugerens tilmelding til spilportalen eller til en service (dvs. med afsendelsen af en anmodning om oprettelse af adgangsberettigelse (kontoåbning) og med indlogning på den pågældende servicer platform, accepterer brugeren brugerbetingelserne). Ved tilmeldingen bliver brugeren opfordret til at være indforstået med brugerbetingelserne. Brugerbetingelserne gælder for enhver brug af servicen, også fremtidige kontrakter, tilbud, ydelser og leveringer fra ejeren.

  2. Brugerbetingelserne bliver offentliggjort på spilleportalen og indenfor rammerne af servicerne. Disse brugerbetingelser kan gemmes i udklipsholderen, gemmes på en permanent datalagringsenhed eller printes ud. På forespørgsel fra brugeren kan brugerbetingelserne imidlertid også tilsendes.

  3. I tillæg til og i forlængelse af disse brugerbetingelser gælder spilleregler og spilleinstruktionen, som anføres i forbindelse med den pågældende service.

  4. Disse servicer retter sig udelukkende til forbrugere i henhold til § 13 BGB. Brugen af servicen til erhvervsformål eller andre industrielle formål er udelukket. Brugerberettiget er alle personer, som på tidspunktet for tilmelding er fyldt 18 år. Mindreårige er kun berettigede til brug af servicerne med deres lovmæssige værges indforståelse.

  5. Med tilmeldingen forsikrer brugeren udtrykkeligt for sin myndighed og solvens eller også - i tilfældet med mindreårige - at den lovmæssige værges accept foreligger.

  6. Brugerforholdet begynder ved tilmeldingen til spilportalen eller til en bestemt service og via godkendelsen af tilmeldingen fra ejerens side i form af oprettelse af adgangsberettigelse (konto). Det ender med brugerens opsigelse, for eksempel ved sletning af sin konto, eller via spærring eller sletning af ejeren eller via ejerens opsigelse.

  7. Med afsendelsen af tilmeldingsformularen afgiver brugeren et bindende tilbud om afslutning af en servicebrugeraftale (også "anmodning om åbning af en service-konto"). Derved skal alle indtastningsfelter i registreringsformularen være udfyldt korrekt.

  8. De i disse Generelle Forretningsbetingelser nævnte kontrakter mellem ejeren og brugeren kommer grundlæggende først i stand med ejerens accept af hhv. anmodningen om indgåelse af en servicebrugeraftale eller anmodningen om indgåelse af en kontrakt om brug af tillægsydelser. Accepten kan følge eksplicit eller følge af ejerens første opfyldelse som følge af betalingen. Adgangen, som følge anmodningen om åbning af en servicekonto eller som følge af tilbudet om brug af tillægsydelser bliver af ejeren omgående bekræftet ad elektronisk vej via den af brugeren angivne e-mail adresse. Adgangsbekræftelsen udgør ingen bindende accept af anmodningen om at blive bruger. Adgangsbekræftelsen kan dog være forbundet med erklæringen om accept.

§ 2 Ydelsesomfang

  1. Ejeren gør det grundlæggende muligt for brugeren at deltage i sine servicer i deres udformning til den pågældende tid ved at stille dem til rådighed gennem internettet. Brugeren skal selv sikre sig forudsætningerne for deltagelse i servicerne.

  2. Brugeren har intet krav på deltagelse i ejerens servicer. Specielt forbeholder ejeren sig ret til at afvise en tilmelding til en eller flere servicer uden begrundelse eller at begrænse den.

  3. Ejeren garanterer ikke, at servicerne opfylder brugerens krav. Specielt påtager ejeren sig ingen garanti for at servicerne egner sig til de af brugeren opstillede mål.

  4. Brugeren gøres opmærksom på, at en uafbrudt og fuld funktionsdygtig rådighed over servicerne til enhver tid for brugeren ikke er mulig. Ejeren garanterer dog en tilgængelig for spillene på 92% (tooghalvfems procent) i årsgennemsnit. Herfra undtaget er tider, hvor serverne ikke er tilgængelige via internettet på grund af tekniske eller øvrige problemer, som ligger udenfor ejerens indflydelsesområde (klimaindflydelse, forårsaget af tredjemand osv.), på samme måde som tidspunkter, hvor der udføres rutinemæssigt vedligeholdelsesarbejde. Ejeren kan begrænse adgangen til servicerne, såfremt internetudbyderens sikkerhed, opretholdelsen af internettets integritet, specielt undgåelse af tungtvejende forstyrrelser på nettet, softwaren eller de lagrede data kræver dette.

  5. servicerne er underlagt en konstant videreudvikling, tilpasning og forandring. Af denne grund kan ejeren til enhver tid tilpasse sine servicer indholdsmæssige, optiske, tekniske og øvrige fremtrædelsesform. Et krav fra brugerens side på at opretholde bestemte tekniske rammebetingelser eller givne forhold består herved ikke. Brugeren modtager udelukkende en brugerret til de pågældende servicer i deres på det pågældende tidspunkt aktuelle form.
    Brugeren har intet krav på opretholdelse af servicerne i den ved kontraktafslutningen bestående form.
    Ejeren forbeholder sig ret til at indstille driften af servicerne til enhver tid, uden angivelse af grunde. I dette tilfælde kan brugeren i henhold til § 3 (5a) forlange, at de overfor ham allerede ydede fordele (eksempelvis til gengæld for premiumvaluta) enten indsættes i en anden af ejerens tilbudte servicer eller at ejeren erstatter fordele, som er betalt på forskud. Yderligere krav fra brugerens side på grund af indstilling af servicer er udelukket.

  6. Henvisninger, tips og råd til afvikling af servicer, som ejeren og dennes medarbejdere og betalings- og driftsmedhjælpere uddeler, er altid uforpligtende. Brugeren har ikke noget krav på erstatning af ulemper, som disse har medført.

  7. Såfremt intet andet er udtrykkeligt anført i beskrivelsen af servicernes ydelser, er de af ejeren til rådighed stillede servicer gratis. Bestemmelser i § 3 forbliver heraf uberørte.

§ 3 Premiumvaluta, tillægsydelser, betalingsbetingelser

  1. Ejeren giver ved enkelte servicer brugeren mulighed for, at skaffe såkaldte premiumvalutaer (Coins, Diamanter, Kulstykker, Ædelsten, Farvesplinter, …) mod en betaling. Prisen for premiumvalutaen bliver bekendtgjort på internetsiden for den pågældende service. Anskaffelsen forudsætter en yderligere – uafhængig af servicebrugeraftalen – kontraktindgåelse (Kontrakt om Brug af Tillægsydelser). Denne følger indenfor rammerne af en særskilt og tydeligt kendetegnet bestillingsproces. Bestillingsprocessen afslutter med knappen „køb“. Brugeren afgiver med aktiveringen af denne knap en viljeerklæring, som forpligter vedkommende til betaling af det pågældende beløb ved afslutningen på kontrakten.

  2. Ved hjælp af premiumvaluta har brugeren mulighed for at erhverve sig enkelte tillægsydelser i forhold til en normal konto. Bestillingen af bestemte tillægsydelser i spillet er ikke nogen selvstændig kontrakt, men udelukkende brugerens ret til at bruge sin anskaffede premiumvaluta indenfor rammerne af den under § 3 afsnit 1 nævnte kontrakt. Den nærmere beskrivelse af de fremskaffede tillægsydelser og mængden af premiumvaluta, som fremskaffelsen af dem koster, fremgår særskilt af internetsiden for den pågældende service og varierer alt efter service. Premiumvalutaen gælder altid kun indenfor den service, hvor den er fremskaffet, og de kan grundlæggende set ikke overføres. Gyldigheden af premiumvalutaen er begrænset til 12 måneder fra anskaffelsesdatoen.

  3. For tillægsydelserne gælder i tillæg til disse brugerbetingelser de tilsvarende beskrivelser af ydelserne som særlige betingelser. Ejeren forbeholder sig ret til at ændre arten, omfanget og indholdet af tillægsydelserne.
    Specielt forbeholder ejeren sig retten til, i forbindelse med videreudvikling og tilpasning af servicerne, at ændre enkelte tillægsydelser, ikke længere at tilbyde disse og/eller at gøre dem til en gratis del af servicen.

  4. Det er ingen pligt til at anskaffe premiumvaluta. Tillægsydelserne kan bestå af enkeltstående ydelser eller være tidsmæssigt begrænsede. Tidsmæssigt begrænsede tillægsydelser bortfalder igen efter udløb af den bestilte tid og kan derefter bestilles påny, hvis de stadigvæk udbydes af ejeren.

  5. En erstatning eller kompensation for én gang erhvervet og til brug af tillægsydelser anvendt premiumvaluta er i princippet ikke muligt. Dette gælder ikke, hvis kontrakten om brug af tillægsydelser er blevet fortrudt retmæssigt i henhold til § 4. Dette gælder heller ikke, hvis servicen eller den af brugeren fremskaffede tillægsydelse i løbet af den kontraktmæssigt aftalte varighed enten ændres af ejeren, ophæves eller tilbydes gratis.

    a. Premiumvaluta, som er anskaffet for penge indenfor ti uger før en service ophører, kan veksles til premiumvaluta med samme værdi til en anden af ejeres services. Hvilken bestemmes af brugeren. Alternativt kan brugeren forlange en erstatning af premiumvaluta, som han har anskaffet sig hos ejeren for rigtige penge indenfor to uger før ophør af servicen. Et sådant krav skal brugeren rette skriftligt til support@upjers.com indenfor ti uger efter erhvervelsen af premiumvalutaen.

    b. Såfremt brugeren allerede har brugt premiumvaluta forud for et bestemt tidsrum for brugen af tillægsydelser for en fremtidig tidsperiode og ikke kan gøre brug af disse tillægsydelser pga. årsager foranlediget af ejeren (f.eks. ophævelse af tillægsydelserne, vedvarende utilgængelighed af tillægsydelserne, optagelse og udbydelse af tillægsydelserne i de gratis servicer), vil ejeren som erstatning først og fremmest tilbyde andre tillægsydelser og/eller erstatte det brugte beløb (henholdsvis værdien af premiumvalutaen), udregnet efter tid, overfor brugeren.
    Brugerens ret til ekstraordinært at ophæve kontrakten om brug af tillægsydelser pga. de ikke brugbare tillægsydelser iht. § 8 afsnit 4, forbliver uberørt af dette. Yderligere krav fra brugeren er udelukket.

  6. Til brug af tillægsydelser er ejeren berettiget til at forlange modydelser i form af premiumvaluta betalt forud. Betalingen for erhvervelse af premiumvaluta forfalder omgående med indgåelse af kontrakten, dvs. med bekræftelsen på erhvervelsen af premiumvaluta. Ejeren tilbyder forskellige betalingsmetoder. Brugeren har intet krav på at ejeren tilbyder bestemte betalingsmuligheder eller vedligeholder disse. Betalingerne bliver foretaget ud fra brugerens valg af betalingsmetode. Brugeren bliver udtrykkeligt gjort opmærksom på, at betalingsudbyderne, som på vegne ejeren trækker beløbene afhængigt af den valgte betalingsmetode, kun overfører en del af de af brugeren opkrævede beløb til ejeren. Undtagen i tilfælde af en virksom fortrydelse begrænses brugerens krav på tilbagebetaling eller erstatning grundlæggende set til det af ejeren rent faktisk modtagne netto-beløb. Det af betalingstjenesteudbyderen fratrukkede beløb bliver ikke erstattet af ejeren.

  7. I tilfælde af manglende betaling er ejeren berettiget til at stoppe tillægsydelserne, samt omgående at spærre den pågældende brugers konto. Brugerens forpligtelse til at betale det aftalte beløb forbliver uberørt af dette.

  8. Opstår der for ejeren ekstra udgifter eller byrder på grund af forhold, som kan tilskrives brugeren, så bærer denne de heraf opståede udgifter overfor ejeren. Ejeren er i dette tilfælde berettiget til at opkræve disse udgifter igen sammen med den oprindelige betaling.

  9. Krav fra ejerens side kan af brugeren kun besvares med uomtvistelige eller retsgyldige modkrav. Brugeren kan kun opretholde en ret til ikke at efterkomme ejerens krav, hvis brugerens modkrav beror på det samme kontraktforhold. Afgivelse til tredjemand af krav fra brugerens side mod ejeren er udelukket.

§ 4 Oplysning om fortrydelsesret vedrørende premiumvaluta og tillægsydelser

Fortrydelsesret:

Du har ret til at fortryde denne kontrakt inden fjorten dage uden angivelse af grunde. Fortrydelsesfristen udgør fjorten dage fra dagen for indgåelse af kontrakten. For at gøre brug af din fortrydelsesret skal du informere os om din beslutning om at fortryde denne kontrakt via en utvetydig erklæring (f.eks. i et brev sendt med posten, en telefax eller en e-mail) til nedenstående kontaktoplysninger:

    Til overholdelse af fortrydelsesfristen er det tilstrækkeligt, at du sender meddelelsen om udøvelse af fortrydelsesretten inden fortrydelsesfristens udløb.

Konsekvenser af fortrydelsen:

Hvis du fortryder denne kontrakt, vil vi tilbagebetale alle betalinger, som vi har modtaget fra dig, inklusive leveringsomkostningerne (med undtagelse af de yderligere omkostninger, som er et resultat af at du har valgt en anden art af levering end den af os valgte billigste standardlevering) senest inden fjorten dage fra den dag, hvor din meddelelse om din fortrydelse af denne kontrakt er indgået hos os. Til denne tilbagebetaling anvender vi det samme betalingsmiddel som du benyttede til den oprindelige transaktion, undtagen hvis noget andet er blevet udtrykkeligt aftalt med dig; på ingen måde bliver der påregnet udgifter for dig ved denne tilbagebetaling.

Slut på oplysningen om fortrydelsesret

Særlig henvisning

Din fortrydelsesret ophæves før tid, hvis upjers er begyndt med udøvelsen af kontrakten, efter at du udtrykkeligt har accepteret, at upjers begynder med udøvelsen af kontrakten inden at fortrydelsesfristen begynder, og du har bekræftet dit bekendtskab med at du via din accept af påbegyndelsen af udføringen mister din fortrydelsesret.

§ 5 Reklamation

  1. Ejeren stiller adgang til servicerne og tillægsydelserne til rådighed overfor brugeren in den på det givne tidspunkt aktuelle tilstand. Brugeren har ikke noget krav på opretholdelse eller arbejden henimod en bestemt tilstand/funktionsomfang for servicerne og tillægsydelserne.

  2. Brugeren er bevidst om at den af ejeren til rådighed stillede software indenfor rammerne af servicen - som al software - ikke kan være fuldstændig fejlfri. Som mangelfuld anses servicen derfor kun, når dens spilbarhed er ødelagt betydeligt og permanent.

  3. Til brugerens egen sikkerhed og i særdeleshed af hensyn til sikring af beviser, anbefales det brugeren, at rette samtlige reklamationer til ejeren skriftligt (eller per e-mail)

  4. Før indrapportering af en eventuel fejl skal brugeren først gennemse servicevejledningen og eventuelt af ejeren andre til rådighed stillede hjælperedskaber til problemløsning (specielt lister med ofte stillede spørgsmål, diskussionsfora omhandlende problemer). Brugeren bør ved en fejlrapportering støtte ejeren efter evne.

  5. Garantier i retshenseende påtages ikke af ejeren, så længe intet andet er udtrykkeligt aftalt skriftligt.

§ 6 Ansvar

  1. For så vidt som at ejeren tilvejebringer gratis ydelser, hæfter ejeren på ingen måde for andre end groft uagtsomme eller med vilje forårsagede skader.

  2. Såfremt ejeren kræver betaling for ydelser, hæfter han uindskrænket ved forsæt og grov skødesløshed.

  3. Ved mild uagtsomhed hæfter ejeren kun i tilfælde af krænkelse af en væsentlig kontraktforpligtelse. Under væsentlige kontraktforpligtelser, også kaldet kardinalforpligtelser i hht. retspraksis, skal sådanne pligter forstås, som muliggør den reglementerede gennemførsel af kontrakten og på hvis opfyldelse brugeren brugeren kan regne med. Erstatningspligten er efter størrelsen begrænset til forudseelige og kontrakttypiske skader.

  4. Bestående ansvarsudelukkelse består dog ikke ved ansvar for skader på liv, legeme og sundhed. Den gælder heller ikke, såvidt skaden beror på en krænkelse af en væsentlig forpligtelse i henhold til kontrakt eller krænkelse af en garanti. Ejerens ansvar ifølge produktansvarsloven samt indenfor andvendelsesområde af § 44 a TVG forbliver uændret.

  5. Forestående ansvarsudelukkelser eller -begrænsninger gælder også med henblik på ansvar hos ejerens ansatte, arbejdstagere, medarbejdere, repræsentanter og betalingsmedhjælpere især med hensyn til andelshavere, medarbejdere, repræsentanter, organer og disses medlemmer med henblik på deres personlige ansvar.

  6. Ejeren distancerer sig udtrykkeligt fra indhold på samtlige sider, til hvilke der findes henvisninger ("links") blandt ejerens forskellige tilbud. Ejeren tager intet ansvar for disse siders indhold. For indholdet på disse sider er udbyderne af disse pågældende sider selv ansvarlige. En kontrol af informationerne under de forskellige links fra ejerens side sker ikke. Krænkelser af gældende lov fra de linkede siders indhold er ejeren ikke bekendt med. Ved underretning om sådant, bliver linket selvfølgelig omgående fjernet.

  7. Der er med de forestående regler ikke forbundet en ændring af bevisbyrden til ulempe for brugeren.

§ 7 Brugerens forpligtelser

  1. Brugeren forpligter sig til at holde adgangsdata til de enkelte servicer hemmelige. En videregivelse til tredjemand er ikke tilladelig.

  2. Brugeren forpligter sig til kun at benytte én konto på samme tid ved hver service. Den samtidige brug af flere konti ved samme service (såkaldte multi-brugere) er ikke tilladt.

  3. Benyttelse fra brugerens side af scripts eller programmer til automatisk udførelse af deltagelse i servicerne (såkaldte bots) er ikke tilladt.

  4. Brugeren forpligter sig til ikke med hensigt at skaffe sig en fordel ved brug af servicerne via programmeringsfejl eller -huller i servicerne (såkaldte bugs). Allerede opnåede fordele skal tilbagegives eller udlignes og kan af ejeren blive ophævet. Brugeren skal holde faktiske eller formodentlige bugs eller uregelmæssigheder hemmelige og omgående melde dem til ejeren.

  5. Brugeren forpligter sig til ikke, inden for rammerne af servicen, at udbrede billeder, links, navne, ord eller andre ytringer med reklamerende, politisk, krænkende, sexistisk, pornografisk eller øvrigt moralsk forkasteligt indhold, i særdeleshed racistisk og højre- eller venstre ekstremt. Yderligere forpligter brugeren sig til ikke at anvende ophavsretsligt beskyttede begreber, navne eller billeder. I tvivlstilfælde har brugeren at slette indhold efter påtegning fra ejeren og ejeren har desuden ret til selv at slette det.

  6. Bestemmelserne fra ejerens og dennes medarbejderes side samt dennes betalings- og vedligeholdelsesmedhjælpere skal følges af brugeren. Dette gælder specielt også for anvisninger fra administratorer og moderatorer i et eventuelt forum hørende til den pågældende service.

  7. En regelbrydende overtrædelse af den ovennævnte pligter berettiger ejeren til omgående og til enhver tid at udelukke brugeren fra videre deltagelse i den pågældende service og til spærring eller sletning af den pågældende brugers konto. En erstatning eller godtgørelse for premiumvaluta, som befinder sig på en eller flere konti på tidspunktet for sletningen, eller for allerede erhvervede og stadigvæk gyldige tillægsydelser følger ikke.

§ 8 Opsigelse

  1. Brugeren er til enhver tid berettiget til at opsige sin deltagelse i enkelte, flere eller alle servicer uden begrundelse og uden at overholde nogen tidsfrist.

  2. Ejeren er til enhver tid berettiget til at opsige enkelte, flere eller alle servicer uden overholdelse af en tidsfrist, hvis servicen eller servicerne nedlægges.

  3. Har brugeren forud bestilt tillægsydelser vha. premiumvaluta for et bestemt tidsrum, så er retten til ordinær opsigelse udelukket indenfor dette tidsrum.

  4. Begge parters ret til at opsige hhv. servicebrugeraftalen eller kontrakten om brug af tillægsydelser af til enhver tid vigtige grunde (ekstraordinær opsigelse) forbliver uberørt.

  5. Hvis ejeren gør brug af den ekstraordinære opsigelse af hhv. servicebrugeraftalen eller kontrakten om brug af tillægsydelser, bliver brugeren kompenseret efter andel for de af ham forud betalte ydelser, som gælder ud over opsigelsestidspunktet eller får en godtgørelse for den indløste premiumvaluta (specielt til gengæld for tillægsydelser). Yderligere krav fra brugerens side er udelukket, såfremt ikke andet er aftalt i disse bruger betingelser.

  6. Ejeren er specielt, men ikke udelukkende, berettiget til opsigelse af betydningsfuld årsag, hvis

    • brugeren kommer i restance på mindst 5 Euro eller mere med betalingen af modydelser og ikke betaler trods gentagne påmindelser,
    • brugeren selvforskyldt overtræder reglerne og ikke ophører med overtrædelserne trods advarsler; en advarsel kræves ikke, hvis en fastholdelse til kontrakten ikke kan kræves af ejeren, for eksempel i tilfælde af særligt grove overtrædelser af reglerne (flere konti per spiller, strafbare handlinger, ...)
    • brugeren ikke har benyttet sin konto i fire uger trods henstillinger.
  7. Hvis der på servicernes platform ikke er mulighed for opsigelse via en bestemt funktion, skal enhver opsigelse følge på tekstform (e-mail). Den ekstraordinære opsigelse skal altid følge under nævnelse af årsager.

  8. Af tekniske årsager følger den endegyldige sletning af brugerdata og kontoen først med en forsinkelse på et par dage.

  9. I tilfælde af en berettiget opsigelse af betydningsfulde grunde tilbagestår der fra brugerens side intet krav på erstatning for de af opsigelsen berørte servicer eller tillægsydelser.

§ 9 Skriftlig form

Sideaftaler til disse generelle brugerbetingelser samt ændringer, udvidelser eller ophævelser af disse brugerbetingelser kræves skriftligt for deres gyldighed. Dette gælder også for ændringer af kravet om den skriftlige udformning. Gyldigheden af individuelle eller udtrykkelige kontraktaftaler bliver ikke berørt heraf.

§ 10 Overdragelse af rettigheder

(1) De rettigheder til indhold, som en bruger indsætter indenfor rammerne af servicer, forbliver hos den pågældende bruger. Med indsættelsen overdrager brugeren udelukkende ejeren en simpel, gratis brugsret til indholdene, som kan trækkes tilbage til enhver tid. Specielt retten til at gøre indholdet offentligt tilgængeligt.

§ 11 Salvatorisk klausul og øvrigt

  1. Skulle enkelte bestemmelser i disse generelle forretningsbetingelser være uvirksomme, så berører dette ikke virksomheden af de øvrige bestemmelser.

  2. For disse brugerbetingelser og for alle kontrakter indgået på basis af disse brugerbetingelser gælder Forbundsrepublikken Tysklands lov. Anvendelse af FNs købsret omhandlende køb af transportable goder samt den tyske internationale privatrets kollisionsregler er udelukket.

Ejeren forbeholder sig ret til altid at ændre eller udvide disse brugerbetingelser med virkning ud i fremtiden, såfremt dette bliver nødvendigt (f.eks. tilpasninger til rets- og lovsituationen, udvidelse af ejerens serviceområde osv.) og såfremt brugeren herved ikke bliver forfordelt efter tro og love. Gør brugeren ikke indsigelse mod de ændrede brugerbetingelser indenfor fristen på en (1) måned efter meddelelsen om disse og deraf følgende mulighed for opnåelse af kendskab til disse eller bruger han disse fortsat, så bliver de ændrede eller udvidede brugerbetingelser retskraftige overfor ham. In advance: We adhere to the data protection laws and protect your sphere of personal privacy in the best way possible. But we also want to be completely honest: the internet lives from data exchange and still displays many security leaks. Even when your data is encrypted while you are visiting our website, there is always a remaining risk, at the latest with the exchange of foreign websites. 4. Deletion of Data and Storage Period of Data

As long as not stated differently, we delete your data as soon as we do not need it any more. A blocking or deletion of your data also occurs when a storage limit, which is required by law, is ending unless there is a further need to save the data for a contract closing or a contractual performance. Certain data might have to be saved longer due to legal reasons. Of course, you can always obtain information about the saved data.

5. How Is your Personal Data Protected?

We will take all useful and suitable measures to protect the personal data saved by us from abuse, loss or unauthorized access. Therefore, we have taken several technical and organisational measures. This includes measures how to deal with every alleged data corruption possible.

If you have the suspicion that your personal data have been abused or have been lost, or that an unauthorized access has taken place, please let us know this as quickly as possible and turn to the contact data mentioned above!

6. Visit of the Website

If you only want to have a look around at our website, we do not gather any personal data with exception of the data your browser is transmitting in order to enable the visit of the website. This concerns especially:

  • the approximate localisation based on the IP-area (only country of the port)
  • Internet-provider (for example, Telstra, Vodafone or Comcast)

Purpose of the temporary storage of data at the beginning is to secure the connection as well as the accessibility and the correct depiction of our website.

Legal basis is the so called legitimate interest in the frame of the above mentioned security measures, which has also been verified in accordance with the European Data Protection Requirements from Article 6 Paragraph 1 lit. GDPR. In accordance with that our interest in a secure and disruption-free provision of our services permits the utilization of the above mentioned technical data, which constitute due to their nature only a very small interference with the visitors’ informational self-determination.

7. Requests to our Customer Support

You have the opportunity to contact our support team. With clicking at “support” on our websites, you will be forwarded to https://support.upjers.com/de/start. A request is furthermore possible via email to support@upjers.com.

The following data can be requested by us:

  • upjers ID
  • email
  • if necessary, payment service provider

  • plug-ins (for example, Adobe Flash)

As a measure of protection, the support request is forwarded via an encrypted connection. Furthermore, we apply the basic principle of data minimisation and only gather data in the support form, which is effectively important. After the successful contacting with you and the ending of the support case, your data will be deleted immediately.

Purpose of the requested data is exclusively contacting and supporting you, which is why the data are also only used for this purposes.

Legal Basis is your consent (Article 6 Paragraph 1a, GDPR), which you give by contacting the support.

8. Downloading of Apps

Through our websites you can also reach our game range in the app stores for mobile terminal devices (in the following: apps) via a link.

During the download of an app, necessary information will be raised by the app store in question, especially the point in time of the download, title, language version and an advertiser ID/ individual device ID. We have no influence whatsoever on these data and are not responsible for it. The app stores provide you with their own data protection declaration concerning the handling of personal data.

We process data within the scope of app usage, as far as it is necessary for the download of the mobile app to your terminal device, the supply of the game in question and the liquidation of in-game purchases.

9. Registration

Additionally, you have the possibility to register yourself on our website and log in afterwards whenever you want with your user account. To register yourself, the following data is needed:

  • email address
  • user name and/ or log in name
  • password

As a measure of protection, the transmission of the data entered by you will take place via an encrypted connection. Further, we apply the basic principle of data minimisation and only raise the data, which is effectively needed. Please do not use your real name or the one of a different person as a user name. We also assign you, depending on the transmitted IP-address, to a country. This data is saved in order to show you the corresponding offer of payment methods. You can change the selection at any time. After creating a user account, your data will be saved until you decide to change certain data or to delete the whole user account.

Purpose of the raised data is the creation of a user account in order to use our browser games and extended functions on the website (for example, in-game messages, post in the forum). Registration is voluntarily and can always be revoked and/ or the user data deleted.

Legal Basis is the user's consent in accordance with the European Data Protection Requirements from Article 6 Paragraph 1 lit. GDPR, which can be given by sending the registration form.

10. Usage of Integrated Games/Additional Features

Some of our upjers-games are embedded in social networks (for example Facebook). The games will be called there, for example, “apps” or “applications”. Furthermore some games might provide additional features, which allow in connection with a certain network the interaction between players (e.g. Twitch extensions). For its data processing and possible data transmission in accordance with data protection, the respective network itself is responsible and enlightens the user in its own data protection declaration. We would like to point out, however, that you might be asked by the network to agree to the transmission of personal data if you want to use an integrated upjers game or additional features in the scope of a network. In the case of Facebook, the following data can be affected:

  • first name, surname, sex, birth date
  • profile picture or corresponding URL
  • log-in email address, which has been used at the registration of Facebook
  • location and access devices
  • user-ID- number, which is linked to public accessible information (on Facebook)
  • user-ID- number to your friends, which are likewise connected with the game

As long as you agree to the data transmission, the network might send in some circumstances data to upjers. upjers will only process such data if it is absolutely necessary for providing you with the game or certain additional features. upjers points out that you can influence the extent of information yourself, which the network is transferring, through the corresponding privacy settings. Exertion of influence could especially be exercised through

  • controlling, which information your Facebook friends share with you/ about you,
  • blocking certain applications, and/ or preventing them from raising certain information about you,
  • ignoring certain invitations to games,
  • controlling, who can see all your activities.

11. Social Sign-In & Social Log In

Besides the manual registration, we also offer you the possibility to directly register yourself at upjers with your already existing user account from another platform (e.g. Facebook, Amazon). If you would like to use this form of registration, you will be forwarded to the website of the provider in question after the selection of the platform and navigated through the registration process there.

As a measure of protection, transmission of the data entered by you will take place via an encrypted connection to the platform in question. We do not use the registration to access personal data like friend lists, or contacts, or for saving them for our own purposes. A temporary connection between your user account and the user account of Facebook and Amazon does not take place.

Both networks are subjected to the EU Standardized Contractual Terms and Conditions and by doing so a possible data transfer to the USA is legitimated (for further information please consult the the respective data protection declarations). Which data is raised by networks in the scope of the registration or how the data is connected, is not known to us. Further details can be found in the data protection declaration of Facebook (https://de-de.facebook.com/policy.php) and Amazon (https://www.amazon.com/gp/help/customer/display.html?nodeId=468496).

Purpose of the data asked is the registration via an already existing user account for the use of extended functions on the website. The registration via social networks is voluntarily and can always be recalled and/ or the user account can be deregistered.

Legal Basis is your agreement in accordance with the European Data Protection Requirements from Article 6 Paragraph 1 lit. a GDPR, which you can give in the scope of our cookie banners.

12. Communication in the Games

The games run by us offer you the possibility to communicate with us or with other players. We use automatic filter systems, which prevent the plentiful sending of messages, insulting, violence-glorifying, obscene, racist or whatever offensive statements, or news with promotional character. Further, we record: for the purposes of analyses and rectification of technical errors; for the warranty of system security and system integrity; for combatting abusive and/ or unauthorised usage, as well as for the preparation of user statistics on non-personal related basis, and the use of the provided communication channels for a short time. The reports created contain date and time of the news, sender and recipient, the text message, as well as the transmitted amount of data.

Without your agreement, none of our staff-members will read messages. If we have suspicion of abusive and/ or unauthorised usage of the communication channels provided (for example by a report of the recipient), we nevertheless reserve ourself the right to examine the player account in question, as well as the player account from which the message was sent and – if need be – take further measures.

As a measure of protection, the transmission of the data entered by you will take place via an encrypted connection to the platform in question.

Purpose of the processing is the provision of an ingame solution for communication for the exchange of messages between the players.

Legal basis for the temporary storage of data is Article 6 Paragraph 1 lit. a GDPR as well as Article 6 Paragraph 1 f GDPR. The input of data for the purpose of communication is voluntarily, and therefore on the basis of agreement by the user. The use of filter systems serves the purpose of keeping the conditions and protecting the data of third parties. In this purposes lies our rightful interest in data procession according to Article 6 Paragraph 1 lit. f GDPR. The input of data for the purpose of communication is based on your consent in accordance with Article 6 Article 1 lit. a GDPR, which you can give by sending a message. The use of filter systems serves the purpose of keeping the conditions and protecting the data of third parties. In these purposes also lies our rightful interest in data procession according to Article 6 Paragraph 1 lit. f GDPR. The interest to protect our customers from possible criminal offenses, like e.g. insults, eventually outweighs the interest in a completely anonymous communication.

13. Payment Handling

If you initiate a payment process to purchase premium currency, you will have to provide further data. The nature of the required data depends on the chosen payment method. Furthermore, upjers allows you to use anonymous payment methods.

You will have a variety of payment providers to choose from. In addition, the cooperation with third parties involves the payment processing via external payment providers (PayPal, credit card companies, mobile network operators, Paysafecard, cash payment, immediate transfer, etc.). All external payment providers are by law obliged to the secure handling of your data, and they are solely allowed to use your data as far as it is necessary for the fulfilment of their task.

You are able to choose freely which payment method you want to use, and therefore we would like to refer to the privacy policies and regulations of the respective payment provider.

The payment provider will collect personal data of the customer on their own responsibility to execute the payment. Thereafter, a response of the payment provider is sent to upjers, in which the successful completion of the payment process is confirmed. Normally, we don't receive person-related transaction data from the payment providers.

However, we point out that we will save the IP address of the customer when a payment process is confirmed. The sole objective is the fulfilment of our tax obligations. The IP address is used to determine the location of performance for tax objectives. The data is stored according to the fiscal period of time for safeguarding.

As an exception further person-related data will already be collected on our websites in case of the utilization of the following payment methods:

“Purchase by Monthly Invoicing”

In the scope of the payment processing upjers collects person-related data via a form and forwards this to the payment provider Payolution GmbH and the commissioned banking house for the solvency check. Further information regarding the data processing will be provided for you in a special data protection declaration in the scope of the payment process. The processing of your person-related data will only be executed with your consent, which you can give during the payment process.

14. Emails/Newsletter

We will send emails that directly affect the contractual relationship, e. g. contract confirmation, to the email address stated during the registration process.
We will not send you emails that not directly affect the contractual relationship, e. g. newsletter, without your prior consent.

We use the so-called Double-Opt-In Procedure to ask you for giving us permission to provide you with our newsletter. We will only send you a newsletter via email if you confirm that you would like to receive our newsletter by clicking on the link within the notification email.

Of course you can unsubscribe from our newsletter at any time. Therefore, you will find a respective link in every newsletter. Alternatively, you can contact our support staff via the support form or via email: support@upjers.com.

For providing our newsletter we are cooperating with the service provider Emarsys eMarketing Systems AG, Hans-Fischer-Straße 10, 80339 Munich, Germany. We concluded an order data processing contract with this service provider according to the specifications of Article 28, GDPR.

The legal basis for sending emails that directly affect the contractual relationship is the execution of the contract. The legal basis for sending emails that do not directly affect the contractual relationship is your consent in accordance with Article 6 Paragraph 1 lit. a DSGVO.

15. Cookies

To some extent so-called cookies are used on our websites. Cookies are small text files which are normally stored within a folder of your browser. Cookies contain information about the current as well as the last visit of the respective website:

  • name of the website
  • termination date of the cookie
  • arbitrary value

If cookies have no specific termination date, they are solely temporarily stored and will be automatically deleted, as soon as you close your browser or restart the terminal device. Cookies with a termination date remain stored when you close your browser or restart the device. These cookies are deleted at that specific date or if you delete them manually.

On our websites we use the following three types of cookies:

  • required cookies (for example, these are necessary to display the website correctly and to temporarily save specific settings)
  • function and performance-related cookies (these help us, for instance, to evaluate technical data of your visit on our website to prevent error messages). Such cookies serve the goal to enhance our offer with additional features, which exceed the technically necessary level and highly increase the user experience. Furthermore this also includes simple tracking pixels, which anonymously and statistically register certain actions on the sites and especially serve to measure and calculate the advertising campaigns. Legal Basis for the implementation of technically required cookies is the execution of the contractual relationship. The legal basis for the implementation of function- and performance-related cookies is our rightful interest. Under consideration of the low interference intensity the interest in the provision of user-friendly services and the winning of new customers prevails and this allows the utilization of function- and performance-related cookies. The legal basis for the implementation cookies that serve for the analysis of user behavior or the displaying of advertisements is your consent, which you can give in the scope of our cookie banners or in other ways (e.g. 2-click solutions) when visiting our homepage.

16. Youtube

We use YouTube for directly embedding videos. YouTube is operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. When playing the embedded videos, a connection to the Google servers is established and at least your IP address is transmitted for technical reasons. In addition, if you are logged into your account, Google will assign, e.g. information to your personal user account about the videos watched. You can prevent this procedure by logging out from your Google account, before you use our website.

The high security standards of the google platform and the associated privacy policy of google are regarded as protective measures (https://policies.google.com/privacy?hl=en-GB). As Google is based in the USA, a so-called non-member State, further warranties are essential to ensure an adequate European level of data protection. Google is subjected to the EU Standardized Contractual Terms and Conditions and by doing so a possible data transfer to the USA is legitimated.

Furthermore, we embed YouTube videos with advanced privacy settings and a server solution. The user is initially solely shown a preview image, which is loaded from an upjers server. Only after pressing the Play-button is the YouTube frame activated and a limited data exchange with YouTube proceeds.

The purpose of data transmission is to integrate YouTube's video service, which is acclaimed among our users, for them to conveniently access the videos displayed without leaving our website.

The legal basis is your consent in accordance with Article 6 Paragraph 1 lit. a GDPR, which you can give by activating the YouTube player.

17. Google Tag Manager

We use the Google Tag Manager, which is a service of Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland ("Google"). With the help of the Google Tag Manager websites can be managed by using an interface.

According to Google the Google Tag Manager is a cookie-free domain, which does not collect any person-related data. The Google Tag Manager activates other tags, which might collect data. The Google Tag Manager does not access this data. If a deactivation is executed on a domain or cookie level, this continues to exist for all tracking tags, which have been implemented by the Google Tag Manager.

18. Goolge Analytics

We use Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses the aforementioned cookies for advertising and analysing purposes, to analyse our website regarding your user behaviour. The information generated by cookies about the use of this website is transferred to and stored in a Google server based in the USA. However, your IP address is shortened before the usage statistics are evaluated. Therefore, no conclusions can be drawn about your person. For this purpose, we extended Google Analytics on our website by the code “anonymizelp” to ensure the anonymous collection of IP addresses. Google will use the anonymous information collected by cookies to evaluate your use of the website, to compile reports on website activity for website operators, and to provide other services relating to the website and internet use. In addition, Google may transfer this information to third parties if this is required by law, or if third parties process this data on behalf of Google.

However, you can also configure your browser to refuse cookies, or you can prevent Google from collecting and analysing the data by downloading and installing a browser plug-in from Google (https://tools.google.com/dlpage/gaoptout?hl=en-GB). As protective measures we use the anonymisation procedure provided by Google, whereby a subsequent evaluation proceeds on a statistical basis only, but not on the basis of your person. Moreover, we have concluded a specific data protection agreement with Google, which stipulates the protection of your data via technical and organisational security measures. As Google is based in the USA and thus in a so-called non-Member State, further warranties are essential to ensure an adequate European level of data protection. Google has been certified under the so-called EU-US Privacy Shield and has thus demonstrated an appropriate level of data protection (https://policies.google.com/privacy/frameworks?gl=de&hl=en-GB).

The objective of using Google Analytics is the anonymous analysis of your user behaviour on our websites. The information acquired from this procedure helps us to improve our service.

The legal basis is the so-called legitimate interest, which has been examined in order to pursue the objective and within the framework of the aforementioned protective measures, as well as in accordance with the European data protection requirements of article 6 paragraph 1 lit. f GDPR. Moreover, an order data processing contract was concluded, according to the specifications of article 28, GDPR.

19. Google Ads

We use "Google Ads", a service of the Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland ("Google"), on our website.

If you access our website via a Google advertisement, Google Ads will save a cookie on your PC. The effect of such cookies normally expires after 30 days. Normally the following information will be saved as analysis values together with this cookie: unique-cookie-ID, number ad impressions per ranking, last impression, opt-out-information.
These cookies enable Google to recognize your web browser. If a user visits pages of the website of an ad customer and if the cookie saved on their computer hasn’t expired yet, Google and the customer will see, that the user clicked on the advertisement and was forwarded to this site.

We ourselves do not collect and process person-related data in the scope of Google Ads. We are only provided with anonymized statistical evaluations by Google. Due to these evaluations we are able to identify, which of the used advertisement measures are especially effective. We do not have any influence on the scope and the further utilization of the data, which are collected by Google via Google Ads. According to our knowledge Google will receive the information, that you accessed the corresponding part of our website or clicked on one of our advertisements. If you are registered and if you have a Google user account, Google can connect the visit to your user account. As a Security Measure this service is deactivated by default on our websites and can be activated via the cookie banner. Furthermore we concluded a special data protection contract with Google, which stipulates the protection of your data by technical and organizational protection measures.
